1. The contents of this website https://sense.sulzer.com/ (the "Sense Services") are provided to you and operated by Sulzer Management Ltd., a Swiss corporation with its registered address at Neuwiesenstrasse 15, CH-8401 Winterthur, Switzerland ("Sulzer"). 2. By using Sense Services , you (the "User") acknowledge that these Terms of Use apply and that access is granted to the User under the condition that all provisions of these Terms of Use are complied with and are accepted by the User. Any special agreements regarding services or products shall apply in addition to these conditions.
    
3. Sense Services provides access to various online tools (such as online quotations, orders, order status, equipment details, product documentation, condition monitoring etc.) and offers information about Sulzer and affiliated companies of the Sulzer Group ("Sulzer and its affiliates"), their products and services depending on the role of the User.
    
4. All information and content published on Sense Services is provided "as is" and "as available" without any representation or warranty of any kind (neither expressly nor impliedly) including but not limited to warranties of correctness, completeness, accuracy, fitness for a purpose or non-infringement. The information and content may include inaccuracies and errors, be incomplete and outdated. Use of Sense Services, its information and content is at User's own risk. Any information and content contained herein may be changed or deleted by Sulzer at any time without any announcement; the User should not rely on the availability of Sense Services or any part thereof.
    
5. Limitation of Liability: To the maximum extent permitted by applicable law, Sulzer and its affiliates shall not be liable for loss or damage of any kind (whether it be for direct, indirect and/or consequential damage) suffered by the User or any other party in connection with the use or access Sense Services, or information or content contained therein, even if Sulzer has been advised as to the possibility of such damage.
    
6. Sulzer does not warrant that the individual parts of the Sense Services run flawlessly. Furthermore, Sulzer accepts no liability for any manipulation of the internet user's IT system by unauthorized persons. Sulzer expressly points out the risk of viruses and the possibility of targeted hacker attacks. In order to prevent viruses, using the latest browser version as well as installing a regularly updated antivirus software is recommended. Users should strictly avoid opening e-mails of unknown origin or unexpected e-mail attachments.
    
7. The entire content (design, text, graphics etc.) and all trademarks and tradenames on Sense Services are protected by copyright, trademark and/or other intellectual and industrial property rights, and all such rights remain reserved. Sense Services individual elements are the exclusive property of Sulzer and its affiliates. Unless expressly agreed with or authorized by Sulzer, the marks may not, and the content on Sense Services may only be used for own, internal documentation purposes concerning Sulzer, its products and services and only with copyright notices remaining intact. By saving or reproducing software or other data from the Sense Services, the respective terms and conditions are deemed accepted.
   
   The (full or partial) replication, transmission (electronically or by other means), modification, linking or use of the Sense Services is permitted only with the express written authorization of Sulzer.
   
   Furthermore, it is prohibited to use tools (e.g. Spider, Crawler and other automatic tools) designed to systematically and automatically access, index and/or transmit Sense Services content. Sulzer explicitly reserves the right to take action against the responsible parties, namely to claim compensation for damages.
    
8. Sense Services may contain links to websites and other resources of third parties, which are completely beyond the control of Sulzer. Sulzer assumes no responsibility for the suitability, accuracy, completeness, adequacy, legality or otherwise of the contents of such websites or for any offers and services contained therein. The use of such websites and resources is at User's own risk.
    
9. Any use of the Sense Services shall be subject to Swiss law. The exclusive place of jurisdiction in connection with any dispute arising out of or in connection with the Sense Services shall be Winterthur, Switzerland.
